    The Representative of an Overseas Business visa allows businesses involved in news, media, and broadcasting to expand to the UK by bringing their best workers to the country.

    Understanding the Representative of an Overseas Business Visa

    Previously known as the Sole Representative visa, the Representative of an Overseas Business visa has been created so that foreign news agencies, broadcasting organisations and news agencies can come to the UK for a long-term assignment. That allows such businesses to expand their coverage of British affairs.

    The visa was launched in 2022. As it replaced the Sole Representative visa, it can no longer be used by individuals who want to come to the UK to launch a UK branch of their business.

    While holding a Representative of an Overseas Business visa, you will be able to work in your role full-time in the UK. You can also apply to bring dependent family members with you to the UK. The visa has a standard validity period of three years. However, visa holders are not allowed to be self-employed or work for a different company, or claim public funds.

    Visa Eligibility Criteria

    The main criteria to apply for this visa are that you are on a long-term assignment focussed on the UK for an overseas media, news, or broadcasting company. The company will need to be overseas, with its headquarters located outside the UK.

    The UK Government specifies that only workers directly involved in creating the company’s output will be eligible. This includes journalists, news camera operators, and front-of-camera personnel. However, the business’s administrative support staff can’t apply.

    There are also requirements that apply to the individual applicant. You will need to have sufficient funds to support yourself in the country without needing public funds, and have a decent standard of English language capabilities.

    You will need to show your eligibility for this visa and allow your company to expand its coverage to the UK with a range of supporting documentation. You will usually need the following, although the British Home Office can ask for additional evidence:

    • A valid passport. It must also have space for the visa to be placed.
    • Payslips and bank statements from the last six months showing that you have the means to support yourself and any family member dependents who will be joining you in the UK.
    • Evidence of meeting the English language requirements, such as a certificate from taking a language test.
    • Details of the accommodation you will use in the UK.

    Tuberculosis test results are also required if you are coming from a high-risk country.

    Representative of an Overseas Business Visa Application Process

    Having confirmed your eligibility for the visa and gathered the required documentation, you can begin the application process. Follow the steps outlined below:

    1. Use the UK Government website to complete the application form.
    2. Upload your supporting documentation. They can also be scanned at your visa application centre appointment.
    3. Submit your application and pay the application fee.
    4. Book and attend a biometrics appointment with your nearest visa application centre, where your fingerprints and biometric photograph will be taken.
    5. Wait for visa processing, after which you will either be issued the visa or receive a refusal letter.

    Most Representative of an Overseas Business visa applications are made from outside the country. The application process can start up to three months before your planned travel to the country. However, you may also switch to the visa while legally in the UK on certain long-term visas. The processing time is around three weeks for applications made outside the UK and eight weeks if you are already in the UK and switching from another visa type.

    Where you apply from will also alter the application fee. This is £819 for applications made outside the UK and £943 for those made inside the UK. In both cases, you will need to pay the annual £1,035 immigration healthcare surcharge.

    Extending Your Representative of an Overseas Business Visa

    Once your visa reaches the end of its initial three-year validity period, you can apply for a further two years’ validity. You will need to continue to meet the eligibility criteria by working for the same employer and ensuring your employer’s headquarters remains outside the country. A letter from your employer will confirm much of this.

    A successful application will usually lead to your Representative of an Overseas Business visa being extended by two years. This may increase to three years if your initial visa was issued before 1 October 2009.

    The visa is also a pathway to indefinite leave to remain, which protects your status in the UK without needing to keep your visa updated. You may make your application after you have been legally living in the UK for at least five years. Getting indefinite leave to remain will also give your business a more secure British presence, which isn’t at the whims of changes to the nation’s visas.
